These Website Terms of Use (“Terms of Use”) govern access to and use of the Italy in a Week website (the “Website”).
The Website is operated by:
ACS S.r.l. (Veditalia)
Registered Office: Via Villoresi 4, 20143 Milan, Italy
VAT / Tax Code: 07277970963
Email: [email protected]
PEC: [email protected]
Companies Register / REA No.: MI-1949531
For the purposes of these Terms of Use, “Veditalia”, “we”, “us” and “our” refer to ACS S.r.l.
1. Purpose and Scope
These Terms of Use regulate access to and use of the Website, including its content, functionality and online services.
They do not govern the purchase or performance of an Italy in a Week package holiday.
Bookings for Italy in a Week are governed by the contractual documentation applicable to the relevant booking, including, as applicable:
- the General Terms and Conditions;
- the Travel Contract and Booking Confirmation;
- the applicable Technical Sheet;
- the itinerary and mandatory pre-contractual information; and
- the applicable insurance documentation.
Where there is any conflict between these Terms of Use and the contractual documentation applicable to a booking, the contractual documentation shall prevail in relation to the booking and package holiday.
Nothing in these Terms of Use limits any rights available to users or Travelers under mandatory applicable law.
2. Use of the Website
Users may access and use the Website for lawful purposes, including obtaining information about Italy in a Week, reviewing available departures and travel services, contacting Veditalia and accessing the booking process.
Users must not use the Website:
- for any unlawful or fraudulent purpose;
- to interfere with or disrupt the operation or security of the Website;
- to introduce viruses, malware or other harmful technology;
- to attempt to gain unauthorized access to the Website, its servers, systems or data;
- to impersonate another person or provide deliberately false or misleading information;
- to infringe the intellectual property, privacy or other rights of Veditalia or third parties; or
- to carry out unauthorized automated extraction, scraping or systematic collection of Website content for commercial purposes, except where permitted by applicable law.
Veditalia may take reasonable technical or organizational measures to protect the Website, its users and its systems from misuse, fraud or security threats.
3. Website Information
Veditalia takes reasonable steps to ensure that information published on the Website is clear, accurate and up to date.
However, general Website content may occasionally require correction or updating, including information relating to itineraries, destinations, schedules, hotels, attractions, availability or other operational matters.
General information published on the Website does not, by itself, override the specific information applicable to a confirmed booking.
Where information displayed on the Website constitutes mandatory pre-contractual information or forms part of a package travel contract, any modification to that information will be governed by the applicable General Terms and Conditions and mandatory package travel legislation.
Photographs, videos, illustrations, maps and other visual materials are intended to provide a reasonable representation of destinations, accommodation and experiences but may not reproduce every detail of the services ultimately provided.
4. Prices and Availability Displayed on the Website
Prices, departure dates, availability and optional services displayed on the Website may change until a booking is concluded.
The price and services applicable to an individual booking will be those identified and confirmed in accordance with the booking process and the relevant contractual documentation.
Nothing in these Terms of Use gives Veditalia an additional right to change the price or services of a package after conclusion of the travel contract.
Any subsequent price revision or modification of a confirmed package is governed exclusively by the General Terms and Conditions and applicable package travel legislation.
5. Online Bookings
The Website may allow users to submit booking requests and purchase Italy in a Week packages, optional experiences, extensions or other services.
The availability of an online booking function does not mean that these Terms of Use govern the resulting travel contract.
The conditions governing:
- formation and confirmation of the booking;
- deposits and payments;
- prices and price revisions;
- cancellations and refunds;
- optional experiences and extensions;
- changes to the itinerary;
- minimum participant requirements;
- insurance;
- Traveler responsibilities; and
- Veditalia’s obligations as Organiser
are set out in the applicable General Terms and Conditions and booking documentation.
Before completing a booking, Travelers will be given access to the contractual and pre-contractual information applicable to their purchase.
6. Third-Party Websites and Services
The Website may contain links to, integrations with or content provided by third-party websites or platforms.
These may include, for example, payment providers, mapping services, social media platforms, embedded content or other technological services.
Where a user leaves the Website and accesses an independent third-party website or service, its use may be governed by the terms and privacy practices of the relevant third party.
Veditalia does not control independent third-party websites and cannot guarantee their continuous availability, security or content.
This Section does not limit Veditalia’s responsibility for travel services forming part of a package organized by Veditalia. Responsibility for the performance of such services is governed by the General Terms and Conditions and applicable package travel legislation.
7. Intellectual Property
Unless otherwise indicated, the Website and its contents are owned by, licensed to or lawfully used by Veditalia.
This includes, without limitation:
- text;
- photographs;
- graphics;
- logos and trademarks;
- videos;
- itineraries;
- layouts and designs;
- databases; and
- other Website materials.
Users may view and use Website content for personal and non-commercial purposes.
Website content may not be copied, reproduced, republished, distributed, modified, commercially exploited or otherwise used without prior authorization from Veditalia or the relevant rights holder, except where such use is expressly permitted by applicable law.
Nothing in these Terms of Use grants users any ownership right in Veditalia’s intellectual property.
8. User-Submitted Information and Content
Where the Website allows users to submit information, messages, requests, reviews or other content, users are responsible for ensuring that the material they provide is lawful and does not infringe the rights of third parties.
Users must not knowingly submit:
- unlawful, defamatory, threatening or discriminatory content;
- malicious files or code;
- fraudulent or misleading information; or
- material that infringes intellectual property, privacy or other third-party rights.
Where reasonably necessary, Veditalia may remove or restrict access to unlawful or inappropriate content submitted through areas of the Website controlled by Veditalia.
Personal data submitted through the Website will be processed in accordance with the Privacy Policy.
9. Website Availability and Security
Veditalia aims to keep the Website accessible and functioning correctly but cannot guarantee uninterrupted or error-free availability at all times.
Access may occasionally be suspended, restricted or interrupted due to:
- maintenance or technical updates;
- cybersecurity measures;
- failures affecting hosting or telecommunications infrastructure;
- third-party technical services; or
- circumstances outside Veditalia’s reasonable control.
Veditalia may modify, update or discontinue Website functions where reasonably necessary.
Such changes to the Website do not, by themselves, modify or terminate an existing Italy in a Week travel contract.
10. Liability Relating to Website Use
Nothing in these Terms of Use excludes or limits liability where such exclusion or limitation is prohibited by mandatory applicable law.
To the extent permitted by law, Veditalia shall not be responsible for losses arising exclusively from:
- temporary unavailability of the Website;
- technical problems outside Veditalia’s reasonable control;
- independent third-party websites accessed through external links; or
- reliance on general Website information that has clearly been identified as non-contractual or illustrative.
This limitation does not apply to Veditalia’s obligations arising from a confirmed package travel contract.
Any liability relating to the organization or performance of an Italy in a Week package is governed by the applicable General Terms and Conditions and mandatory package travel legislation.
11. Privacy and Cookies
Personal data collected through the Website are processed in accordance with the Privacy Policy.
The use of cookies and similar technologies is described in the Cookie Policy, and users may manage applicable cookie preferences through the tools made available on the Website.
The Privacy Policy and Cookie Policy are separate from these Terms of Use.
12. Fraud, Security and Misuse
Veditalia may take reasonable measures where it detects or reasonably suspects fraudulent activity, unauthorized access, misuse of the Website, manipulation of payment systems or other conduct that could compromise the Website, Veditalia or its users.
Such measures may include restricting Website access, preserving relevant technical records, referring suspected unlawful activity to competent authorities or payment providers, and taking other measures permitted by applicable law.
Any action affecting an existing package travel booking will remain subject to the applicable contractual terms and mandatory consumer law.
13. Changes to These Terms of Use
Veditalia may update these Terms of Use from time to time to reflect changes to the Website, its functionality, applicable legal requirements or operational practices.
The latest version will be published on the Website together with its effective or last-updated date.
Changes to these Terms of Use will apply to Website use from the effective date of the revised version.
A change to these Terms of Use does not modify the contractual terms of an Italy in a Week booking already concluded.
14. Governing Law and Jurisdiction
These Terms of Use are governed by Italian law.
Where the user qualifies as a consumer, this choice of law does not deprive the user of any mandatory consumer protection that cannot lawfully be excluded or limited.
Jurisdiction over disputes involving consumers shall be determined in accordance with mandatory applicable consumer protection rules and applicable rules on jurisdiction.
For disputes not subject to mandatory consumer jurisdiction, the Court of Milan, Italy, shall have exclusive jurisdiction.
15. Severability
If any provision of these Terms of Use is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
Where possible, the affected provision shall be interpreted in a manner consistent with its original purpose and applicable law.
